These general terms of use govern the relationship between the Quaric Foundation, publisher of the quaric.org site, and any person who accesses the site or uses its contents, hereinafter referred to as the user.
Accessing and browsing quaric.org constitutes full and complete acceptance of these terms. Users who do not accept these terms are invited to leave the site.
The user agrees not to disrupt the operation of the site, not to introduce unlawful content, not to attempt to extract data through automated means other than those allowed by the robots.txt file, and to respect the intellectual property rights of the Foundation and third parties.
All textual, graphic, audio, video and software content on the site is the exclusive property of the Quaric Foundation or its rightful owners, unless otherwise stated. Any unauthorised reproduction constitutes infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code.
In accordance with the French Trust in the Digital Economy Act, any manifestly unlawful content can be reported to contact@quaric.org. The report must include the date of notification, the identity of the notifier, a precise description and location of the disputed content, and the reasons why the content should be removed.
The Quaric Foundation makes every effort to provide a reliable and accessible site. However, it cannot be held responsible for errors, unavailability or interruptions, nor for direct or indirect damages resulting from the use of the site. External links point to third party sites over which the Foundation has no control and disclaims any liability regarding their content.
The Quaric Foundation reserves the right to amend these terms at any time. Amendments take effect upon publication on this page.
These terms are governed by French law. Any dispute will be submitted to the competent French courts.
At the date of publication of these terms, the Quaric Foundation does not offer any goods or services for sale through the quaric.org site. These general terms of sale are published in anticipation, in accordance with Articles L.441-1 of the French Commercial Code and L.221-5 of the French Consumer Code, in order to govern any future commercial activity of the Foundation, whether addressed to professionals or consumers.
As soon as the Foundation offers a product or service for sale, these terms will automatically apply to any order, unless a specific agreement is signed between the parties. Specific conditions for each product, characteristics, price, delivery terms, will be detailed on the product page or dedicated commercial proposal.
Prices are indicated in euros, excluding tax for B2B sales and all taxes included for B2C sales. The applicable VAT is the one in force on the day of the order. The Foundation reserves the right to modify its prices at any time; confirmed orders are invoiced at the price in force at the time of confirmation.
Any order implies unreserved acceptance of these terms. The order is deemed final after receipt of the Foundation's confirmation and, where applicable, the full payment or agreed deposit.
Payment terms, bank transfer, credit card, other means, are specified at the time of the order. In accordance with Article L.441-10 of the French Commercial Code, the payment period is set no later than the 30th day following the date of issue of the invoice, unless otherwise agreed in writing. Any payment delay automatically triggers penalties calculated at the European Central Bank's interest rate plus 10 points, and a fixed recovery indemnity of €40.
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the consumer has a period of fourteen days from the conclusion of the contract, services, or receipt of the goods, sales of goods, to exercise their right of withdrawal, without having to justify their decision. The request must be addressed to contact@quaric.org.
Goods and services sold benefit by right from the legal guarantee of conformity, Articles L.217-3 et seq. of the Consumer Code, and the guarantee against hidden defects, Articles 1641 et seq. of the Civil Code, under the conditions set by these texts.
In accordance with Articles L.611-1 et seq. of the Consumer Code, the consumer has the option to use a consumer mediator free of charge in the event of a dispute. The name and contact details of the mediator will be published here as soon as commercial activity is set up. Failing amicable resolution, any dispute will be submitted to the competent French courts. This contract is governed by French law.
